Pitfalls in appeal proceedings

In 2023, Arjan van den Steenhoven contributed to an article in a triptych about cassation in the Tijdschrift voor de Procespraktijk (TvPP, Journal of Litigation Practice).

This article briefly discussed the limited possibilities of the Supreme Court to review decisions of lower courts and - partly in connection with this - the necessity for lawyers who litigate in the lower courts to have a good grasp of (appeal) procedural law. Some 'accidents’ in this area cannot be repaired in cassation. Among other things, the article discusses a number of pitfalls in appeals that can lead to a negative recommendation for cassation or to the rejection of the appeal in cassation.

Because (appeal) procedural law is a profession in its own right, we are happy to assist lawyers in the lower courts with their appeals in order to try to increase the chances in cassation or to cut off the way for the other party to a successful cassation appeal.
